These Terms and Conditions govern the use of DigitalArtPrint and the purchase of custom digital art services through https://digitalartprint.shop/. By placing an order, you agree to these terms.
1. Services
DigitalArtPrint provides custom digital portrait and drawing services created from photos or customer instructions. Final files are delivered digitally, for example in PNG or PDF format.
2. Customer responsibilities
You must provide clear reference photos and accurate instructions for your order. By sending photos or other materials, you confirm that you have permission to use them and that they do not infringe any third-party rights.
3. Pricing and payment
Prices are shown on the website, in a quote, or in direct communication before work begins. Full payment, or a deposit if offered, may be required before the order is started.
4. Turnaround time
Estimated delivery times are approximate and may vary depending on order complexity, revision requests, workload, weekends, holidays, or technical issues. Your homepage states that work is usually completed within 24–48 hours.
5. Revisions
Reasonable minor revisions may be included if they are requested promptly after delivery. Major changes, new concepts, or changes outside the original brief may require an additional fee and extended delivery time.
6. Delivery
Completed artwork is delivered digitally using the email address or method agreed at checkout or during communication. It is your responsibility to provide a correct email address and check spam or junk folders if needed.
7. Copyright and permitted use
Unless otherwise agreed in writing, the artist retains the copyright to the artwork. The customer receives a personal, non-exclusive license to use the final artwork for personal use only, and not for resale, commercial exploitation, redistribution, NFT minting, AI training, or modification for commercial purposes without written permission.
8. Portfolio use
We may display completed artwork for portfolio, website, or social media purposes unless you request privacy before work begins. If you want your commission to remain private, please state this clearly when ordering.
9. Cancellations
Orders may be cancelled before work begins. If work has already started, a full or partial refund may be refused depending on the stage of completion and the time already spent on the custom work.
10. Refunds
Because each order is custom-made and delivered digitally, refunds are generally not available once the work has started or the final files have been delivered, except where required by law or where we fail to provide the agreed service. More details are set out in the Returns / Refund Policy.
11. Limitation of liability
We are not liable for indirect, incidental, or consequential losses arising from use of the website or services, except where liability cannot be excluded under applicable law.
12. Governing law
These terms are governed by the laws of European JURISDICTION, without prejudice to any mandatory consumer rights that apply in the customer’s country of residence.
